Emma is very recourceful and so far has been able to go against Regina and eventually win. Besides the court will have to be impartial and they will talk to people who have known the child personally like Archie and Mary Margret. They will let the court know that Henry is misrible with Regina and that she's been a horrible mother and that his life has been getting better ever since Emma came. Though Regina is a sly one who always finds some way to manipulate people. Also I have so say Henry looks so cute in that picture! I know it might sound weird from a guy and I'm strait but I just wanna give that cute little guy a hug and mess up his hair.

I think she will eventually, but I dont think it will happen anytime soon. Also, I wanted to say that I didnt like the way that the scene in which she said she will try to get Henry played out. It made it seem like she was doing it to get back at Regina instead of because she actually wants Henry, even though I definately believe that she does want Henry.

I don't think she will. She has never really been an "unfit" mother. A strict mother yes but it was all done for what she believed to be the best for Henry.

I really don't see how Emma will ever gain custody of Henry, Regina has done a lot of questionable things but she has never put Henry in any danger. All she has done was try and protect him.

So Emma may want Henry but she gave up her right to him when she gave him up for adoption. She may tell herself "it's what's best for him" but she herself is doing it to get back at Regina.

Honestly, Emma's put Henry in a lot more obviously compromising situations. A lot of actions could be used against her, plus, she appears to be playing into what is believed to be his fantasy world, counteracting his therapy and being overall unhelpful.

I hope she gets him away from Regina soon!

Agree with blue_eyes and cassie-1-2-3 100%. There's no way the courts would give Emma custody of Henry.

Not now but eventually yes. She has a good chance, especially with Archie on her side. Rememeber what he said to Regina in episode 5:

"Because someday, Madame Mayor, you might find yourself in a custody battle. And do you know how the Court determines how is a fit parent? They consult an expert, particularly one who has treated the child. So, I suggest that you think about that."

When it comes down to a custody battle,I'm pretty sure that Archie will do everything for Emma to gain custody

While Emma is a better fit for Henry than Regina, she's still not a "fit parent" in any sense of the word.

However, I don't see them throwing this plot-line out there only to have Regina keep him, or have neither Regina nor Emma win custody.

I'd like her to, but I don't see it happening right now. She's won very few battles against Regina, actually. She might get official visitation rights, though, if the judge listens to Henry's wishes.

I don't think so, because the synopsis from "An Apple Red as Blood" says Emma will want to leave Storybrooke. So maybe she'll get him eventually, but not right away.

I'm surprised that so many people thought that Emma could have won custody of Henry in a court battle. Didn't anyone realize that neither woman would have won? Regina and the rest of Storybrooke's inhabitants are not "REAL" citizens of the U.S. And Emma is an ex-convict, who had served time in prison. The court would have sent Henry to a foster home or a foster family.

YES!!!!!! Emma will definitely get custody of Henry because Regina is the worst person ever. She is the Evil Queen and that's what's expected. Still, Henry shouldn't have to be with Regina because she doesn't actually love him. She only loves herself and revenge on Snow White. GO EMMA, GET CUSTODY OF YOUR KID!!!!!!
